GIS Focuses on Strategic Partnerships to Help Clients- March 9th, 2015

Columbia, S.C. - GIS has created a role dedicated to cultivating strategic partnerships in order to help clients hire and onboard quickly and easily.

The Senior Vice President of Sales and Strategic Partnerships role will be filled by GIS' own Nate Gabelman. Gabelman, who has been working in sales for the company since 2002, will be focusing on developing partnerships with companies that provide intrinsic value to GIS' clients. These partners typically offer Applicant Tracking Systems and onboarding solutions like assessment testing, learning management, and more.

"Our goal is to be able to match our clients with vetted providers that directly fulfill the clients' needs," said Gabelman. "In a marketplace saturated with companies providing seemingly identical services this can be easier said than done, but I am dedicated to finding the right partners and the right providers for our clients."

As a sales person for more than 15 years and a GIS salesperson for more than 10, Gabelman is uniquely qualified for this role. During his sales tenure at GIS, he became extremely adept at identifying possible integration partners and working closely with third-parties and with his clients to help speed the integration process. He will be applying this knowledge towards attaining partnerships as dictated by the needs of the clients and the needs of the company.

WOTC Filing Deadline Extended- March 3rd, 2015

Columbia, S.C. - The deadline for filling Work Opportunity Tax Credit (WOTC) forms for eligible employees hired during calendar year 2014 has been extended to April 30, 2015.

Though business usually must apply for WOTC within 28 days of the eligible employee starting, the IRS has extended the filing deadline to reduce the burden on employers due to the hiatus of the program. The program had expired on December 31, 2013, and was only retroactively extended through the end of 2014 in late December 2014.

In order to earn the federal income tax credits, businesses must employ individuals from one of the targeted groups and submit Forms 8850 and supporting documents for each eligible employee. Obtaining a WOTC certification is required in order to claim the credit.

Based on historical legislation and current Congressional committees working on reforming the US tax code, tax consultant experts expect WOTC to be renewed retroactively for at least 2015, if not permanently. Businesses should continue to screen for employee eligibility and submit their Forms 8850 to the State Workforce Agencies (SWAs) for eligible 2015 new hires. Experts also recommend that businesses coordinate with the tax consultants with whom they work to ensure that they can take advantage of the credits when the program is renewed.

Business Tax Credits Renewed for 2014- December 31st, 2014

Tax Reform Bill to Permanently Renew Certain Credits Will Be Heard in 2015

Chapin, S.C. - Congress has passed and President Obama has signed into law the Tax Increase Prevention Act of 2014 which extends certain tax credits and incentives, including WOTC, through the end of 2014.

Because the renewed credits and incentives are retroactive, businesses that hired eligible employees who completed the screening process and applied for credits in a timely manner qualify for federal income tax credits. Thus, any credit that would have been earned over the course of 2014 if the incentives had remained active will still be available when filing, once the State Workforce Agencies (SWAs) issue the employee certificates.

In all, more than 50 expired credits and incentives were renewed. As predicted, Work Opportunity Tax Credits (WOTC), Research & Development credits, Federal Empowerment Zone Credits and Indian Employment Credits all made the cut. Each of these is an integral part of corporate financial planning.

Tax credit & incentives experts are anticipating that WOTC will be renewed permanently in a tax reform bill that will be heard when Congress returns to Washington, D.C. in January 2015.

Experts Anticipating Renewal of Business Tax Credits- December 3rd, 2014

Chapin, S.C. - Tax credit & incentives experts are expecting the United States Congress to renew tax incentives, including WOTC, veteran's tax credits, and many more that have become an integral part of corporate financial planning.

Though more than 50 credits and incentives are up for renewal or extension, much fewer are expected to be passed in this session of Congress. In addition to the aforementioned Work Opportunity Tax Credits (WOTC) and veterans tax credits, incentives that are likely to be renewed include Research & Development credits, Federal Empowerment Zone Credits, and Indian Employment Credits.

Background Screening Report Reveals Retail Industry Trends- July 8th, 2014

Chapin, S.C. - The Retail Industry Background Screening Benchmarking Report, prepared by GIS and slated for release on Thursday, July 10, has revealed a healthy respect for EEOC guidance and a keen understanding of what checks are necessary for what positions.

The report takes an in-depth look at retailers' background check habits including what checks are run, what positions are screened and how retailers are reacting to EEOC guidance and ban-the-box laws. In addition to looking at what checks are currently used, it looks into what checks retailers want to increase or decrease their use of - a much more varied graph than in years past.

"This variation from company to company clearly shows that retailers are focusing on getting their screening services right," says Matt Robbins, Vice President at GIS and resident retail industry expert. "For a long time, background screening was focused on more - more types of checks, done on more employees. With EEOC guidance, all industries have to switch their focus to doing the right checks on the right employees, and the retail industry is at the head of the pack."

General Information Services Announces Settlement of King v. GIS and Dowell v. GIS- June 20th, 2014

Chapin, S.C. - Soon, the parties in King v. General Information Services and Dowell v. General Information Services will file settlement documents asking the court to approve a settlement of the claims in the cases. GIS is releasing information about this proposed settlement because GIS's refusal in the past to comment on pending litigation has resulted in misleading public statements about the cases and about GIS.

Apart from reaching a monetary resolution, the parties agreed on important changes to background reporting that they anticipate the rest of the industry will rapidly adopt. Specifically, when GIS reports a criminal case in which conviction occurred and that is more than seven years old, GIS will remove all non-conviction count information. The settlement sets out narrow exceptions where the provision of that information would be allowed. GIS will also remove any indication of count numbers in the case, so that users of the report will not infer the existence of unlisted counts.

For those who have not been following the cases, GIS's pending motion for summary judgment in the King case sets out the facts underlying the case:

  • GIS reported a single criminal case that resulted in a conviction that occurred more than seven years ago.
  • As a part of reporting the conviction in the case, GIS reported that the plaintiff pled guilty to one count in the charge and that the prosecutor declined to prosecute the other counts in the charge.
  • This information was accurate, was complete, and reflected the publicly available information at the time of the report.
  • The employer decided not to hire the plaintiff on the basis of the one offense for which she pled guilty and was convicted, not on the other offenses.

The plaintiff's claim is that reporting the counts that the prosecutor charged but ultimately decided not to prosecute, as part of reporting the conviction in that same criminal case, violates the Fair Credit Reporting Act's prohibition on reporting "any other adverse item of information, other than records of convictions of crimes which antedates the report by more than seven years."

GIS filed a summary judgment motion based on the facts above, and the plaintiff's lawyers responded thoroughly. The parties disagreed over the following legal issues:

  • Whether the records that GIS reported about the criminal case are "records of conviction" that the FCRA allows.
  • Whether the information about the non-convictions was adverse to the plaintiff.
  • Whether GIS acted on a reasonable interpretation of the FCRA, so was not willfully violating it.
  • Whether the FCRA violates the First Amendment's freedom of speech by prohibiting GIS from communicating public records to someone who is not prohibited from using them.

The plaintiffs' claims in the Dowell case are similar, the main difference being that the users of the reports in the Dowell case certified that the reports were not for employment, but were for access to secure facilities.

Continuing the cases to trial would place financial and management burdens on GIS. The plaintiffs' lawyers have alleged a class action, in which the plaintiffs would represent everyone about whom GIS issued a report in which GIS reported non-conviction count information as part of a case in which a conviction occurred more than seven years ago. This class has approximately 50,000 reports in it. If the jury found GIS to have willfully violated the FCRA (erroneously, in GIS's opinion), GIS would be liable for statutory damages of $100 to $1000 per report. The risk of a runaway verdict, which would absorb resources that could be better used improving GIS's services for its clients, compels GIS to settle the case. GIS does not admit any wrongdoing in the settlement, but is agreeing to pay a total of $3.4m to settle the case.

The settlement sets important standards for the consumer-reporting industry on reporting this kind of non-conviction count information. Under the settlement, when GIS reports a criminal case in which conviction occurred and that is more than seven years old, GIS will remove all non-conviction count information. GIS has already made the operating and system changes that this settlement requires to meet this standard going forward.

The settlement acknowledges that not every report of non-conviction count information over seven years old will violate the FCRA. It therefore includes specific permission to communicate non-conviction count information in the following narrow circumstances:

  • Disclosure of non-conviction count information to the subject of that information
  • Disclosure of non-conviction count information as required by court order
  • Re-communication of archived reports to the original user where the original user is not making any current decision based on the report
  • Reports that are not governed by the FCRA (for example, a report for use in a misconduct investigation that the FCRA defines as not being a consumer report)
  • Reports where an exception in the FCRA allows reporting of non-conviction count information over seven years old
  • Reports where other law pre-empts the FCRA
  • Provision of copies of government documents including non-conviction count information when needed for audit purposes imposed by law or self-regulatory regime (for example, when an employer hires a person into a regulated position)
  • Provision of non-conviction count information for use after the subject of the report requests individualized assessment of the criminal history and the dismissed counts could be relevant to the assessment (for example, under the Equal Employment Opportunity Commission's guidance on criminal history)
  • Provision of non-conviction count information to confirm the that the subject of the report fairly reported his or her own criminal history (for example, when the subject mis-identifies the count on which conviction occurred, but does fairly identify the case)
  • Reports to be used strictly outside the United States
  • Reports to other consumer reporting agencies for their use in preparing a report to an end-user

GIS believes that these exceptions in the settlement establish clear guidance for the industry for when reporting non-conviction count information is not adverse. These exceptions allow the industry to continue playing a positive role in helping employers manage risk and promoting employment of genuinely rehabilitated offenders.

GIS and Turning Point Justice Team Up to Create Easier LP Processes- October 15th, 2013

Chapin, S.C. - GIS, a leading background screening provider, has joined forces with Turning Point Justice (TPJ) to provide Loss Prevention and Asset Protection professionals with an innovative solution that addresses the lack of criminal justice accountability for retail theft offenders.

Turning Point Justice's technology works with local criminal justice agencies and participating retailers to standardize and streamline the detention process and improve the outcome of shoplifting cases. Using equipment and technology provided free to retailers, the TPJ application uses GIS services to quickly confirm suspects' ID, verify addresses and determine the offender's eligibility to participate in a Court Alternative Program (CAP), frequently eliminating the need to involve law enforcement at that time.

The CAP and its partnership with the National Association for Shoplifting Prevention (NASP) allow qualifying offenders to voluntarily agree to pay the retailer restitution and attend a nationally recognized criminal justice rehabilitation course offered by NASP. Working with local criminal justice agencies, TPJ monitors offender compliance, submitting offenders who fail to register for the program as promised to law enforcement for prosecution of the shoplifting offense. By completing the program, including payment of restitution, offenders are held accountable without the time and expense of intense criminal justice involvement for the retailer and the permanency of a criminal history for the offender.

NRMAAdditionally, TPJ's partnership with GIS enables TPJ to enter the offenders who do not complete the rehabilitation course into GIS' FCRA-compliant NRMA Retail Theft Database, helping prevent unrepentant criminals from re-offending. In turn, the partnership serves to strengthen the retail theft database. According to Matt Robbins, head of GIS' retail screening efforts, "GIS' partnership with Turning Point Justice enables us to get high-quality records that meet our - and the FCRA's - standards for reporting to our background screening clients. As one of the few operators of an FCRA-compliant retail theft database, the quality and verifiability of the records is highly important to us and to our clients. We hope that the CAP's innovative use of the database will lead shoplifters to a turning point in their lives."

GIS Releases Dramatic Upgrades to Pangea Onboarding Solution- May 23rd, 2013

The retooled credential management system features fully automated renewal processes, eliminating any manual steps. Background Screening Survey Reveals Retail Industry Trends- April 24th, 2013

Chapin, S.C. - The Retail Industry Background Screening Benchmarking Report prepared by GIS has revealed an increased interest in ongoing criminal monitoring, a reliance on national criminal databases, and more.

The report, which is slated for release on Sunday, April 28, takes an in-depth look at retailers' background screening habits including what checks are run, what positions are screened and what checks they intend to increase their use of. One of the most prominent trends found in this report is the retail industry's desire to increase their use of ongoing criminal monitoring.

"As a background screening tool, ongoing criminal monitoring allows employers to stay current on their employees' criminal background," says Matt Robbins, Vice President at GIS and resident retail industry expert. "This rapidly expanding trend allows employers to screen their employees on an ongoing basis, rather than only pre-hire or when the employee is being considered for a promotion. In doing so, retailers can be confident that the people representing them to the world remain free of barrier records."

In addition to traditional county criminal searches, retailers indicated a heavy use of national criminal databases, with 79% of survey respondents indicating that they use a national criminal database to check at least some of their employees. As most ongoing criminal monitoring systems work off of proprietary databases, this fits well with the number of retailers currently utilizing ongoing criminal monitoring and planning to implement it.

Of special interest was the response to E-Verify. The survey was completed as the Senate proposed an immigration reform bill that would require every employer in the U.S. to utilize E-Verify within four years. The survey showed that more than a third of retailers use E-Verify in all locations as it is, while even more use it where required. There still remains a decent percentage that does not utilize E-Verify, but legislation requiring E-Verify would likely cause very little change in the retail world.

GIS Compliance Webinar Receives Pre-Approval for Re-Certification Credits from HR Certification Institute- March 26th, 2013

GIS Reminds Employers of Renewed Federal Hiring Programs- January 23rd, 2013

Chapin, S.C. - GIS' team of tax credit experts are reminding businesses that, following the recent renewal of some federal hiring programs, employers can once again earn certain valuable tax credits.

Programs that have been renewed include the Work Opportunity Tax Credit (WOTC), Indian Employment Credits (IEC), and Federal Empowerment Zones Program (FEZ). Each of these programs had lapsed on December 31, 2011, but the renewal applies retroactively, allowing employers to capture credits from 2012 through the end of 2013.

Organizations Should Overhaul Tax Credit Screening Programs Now- October 1st, 2012

Chapin, S.C. - Corporations are recommended to take advantage of the (likely temporary) lull in WOTC to overhaul their entire tax credit screening program.

While not the only group of tax credits available to corporations, Work Opportunity Tax Credits (commonly known as WOTC) are perhaps the most common. Its current inactive state gives organizations the opportunity to try out different screening partners and set up their best possible program in time for the expected full WOTC renewal.

Tax Credit ScreeningWhen considering a tax credit screening partner, organizations should be looking for a company that still processes WOTC documents in preparation for WOTC being renewed and that has the ability to easily adapt to potentially new processes for other types of tax credits, such as the tax extenders approved by the US Senate Committee on Finances in early August.

GIS Executive to Appear on SILA Privacy Panel- September 8th, 2011

Columbia, S.C. - GIS has created a role dedicated to cultivating strategic partnerships in order to help clients hire and onboard quickly and easily.

The Senior Vice President of Sales and Strategic Partnerships role will be filled by GIS' own Nate Gabelman. Gabelman, who has been working in sales for the company since 2002, will be focusing on developing partnerships with companies that provide intrinsic value to GIS' clients. These partners typically offer Applicant Tracking Systems and onboarding solutions like assessment testing, learning management, and more.

"Our goal is to be able to match our clients with vetted providers that directly fulfill the clients' needs," said Gabelman. "In a marketplace saturated with companies providing seemingly identical services this can be easier said than done, but I am dedicated to finding the right partners and the right providers for our clients."

As a sales person for more than 15 years and a GIS salesperson for more than 10, Gabelman is uniquely qualified for this role. WOTC Filing Deadline Extended- March 3rd, 2015

Columbia, S.C. - The deadline for filling Work Opportunity Tax Credit (WOTC) forms for eligible employees hired during calendar year 2014 has been extended to April 30, 2015.

Though business usually must apply for WOTC within 28 days of the eligible employee starting, the IRS has extended the filing deadline to reduce the burden on employers due to the hiatus of the program. The program had expired on December 31, 2013, and was only retroactively extended through the end of 2014 in late December 2014.

In order to earn the federal income tax credits, businesses must employ individuals from one of the targeted groups and submit Forms 8850 and supporting documents for each eligible employee. Obtaining a WOTC certification is required in order to claim the credit.

Based on historical legislation and current Congressional committees working on reforming the US tax code, tax consultant experts expect WOTC to be renewed retroactively for at least 2015, if not permanently. Businesses should continue to screen for employee eligibility and submit their Forms 8850 to the State Workforce Agencies (SWAs) for eligible 2015 new hires. Experts also recommend that businesses coordinate with the tax consultants with whom they work to ensure that they can take advantage of the credits when the program is renewed.

Business Tax Credits Renewed for 2014- December 31st, 2014

Tax Reform Bill to Permanently Renew Certain Credits Will Be Heard in 2015

Chapin, S.C. - Congress has passed and President Obama has signed into law the Tax Increase Prevention Act of 2014 which extends certain tax credits and incentives, including WOTC, through the end of 2014.

Because the renewed credits and incentives are retroactive, businesses that hired eligible employees who completed the screening process and applied for credits in a timely manner qualify for federal income tax credits. Thus, any credit that would have been earned over the course of 2014 if the incentives had remained active will still be available when filing, once the State Workforce Agencies (SWAs) issue the employee certificates.

In all, more than 50 expired credits and incentives were renewed. As predicted, Work Opportunity Tax Credits (WOTC), Research & Development credits, Federal Empowerment Zone Credits and Indian Employment Credits all made the cut. Each of these is an integral part of corporate financial planning.

Tax credit & incentives experts are anticipating that WOTC will be renewed permanently in a tax reform bill that will be heard when Congress returns to Washington, D.C. in January 2015.

Experts Anticipating Renewal of Business Tax Credits- December 3rd, 2014

Chapin, S.C. - Tax credit & incentives experts are expecting the United States Congress to renew tax incentives, including WOTC, veteran's tax credits, and many more that have become an integral part of corporate financial planning.

Though more than 50 credits and incentives are up for renewal or extension, much fewer are expected to be passed in this session of Congress. In addition to the aforementioned Work Opportunity Tax Credits (WOTC) and veterans tax credits, incentives that are likely to be renewed include Research & Development credits, Federal Empowerment Zone Credits, and Indian Employment Credits.

Though many of these credits and incentives expired at the end of 2013, renewed expired credits are anticipated to be retroactive. This means that businesses should be able to process forms and apply for credits that would have been earned if the incentives had remained active.

Background Screening Report Reveals Retail Industry Trends- July 8th, 2014

Chapin, S.C. - The Retail Industry Background Screening Benchmarking Report, prepared by GIS and slated for release on Thursday, July 10, has revealed a healthy respect for EEOC guidance and a keen understanding of what checks are necessary for what positions.

The report takes an in-depth look at retailers' background check habits including what checks are run, what positions are screened and how retailers are reacting to EEOC guidance and ban-the-box laws. In addition to looking at what checks are currently used, it looks into what checks retailers want to increase or decrease their use of - a much more varied graph than in years past.

"This variation from company to company clearly shows that retailers are focusing on getting their screening services right," says Matt Robbins, Vice President at GIS and resident retail industry expert. "For a long time, background screening was focused on more - more types of checks, done on more employees. General Information Services Announces Settlement of King v. GIS and Dowell v. GIS- June 20th, 2014

Chapin, S.C. - Soon, the parties in King v. General Information Services and Dowell v. General Information Services will file settlement documents asking the court to approve a settlement of the claims in the cases. GIS is releasing information about this proposed settlement because GIS's refusal in the past to comment on pending litigation has resulted in misleading public statements about the cases and about GIS.

Apart from reaching a monetary resolution, the parties agreed on important changes to background reporting that they anticipate the rest of the industry will rapidly adopt. Specifically, when GIS reports a criminal case in which conviction occurred and that is more than seven years old, GIS will remove all non-conviction count information. The settlement sets out narrow exceptions where the provision of that information would be allowed. GIS will also remove any indication of count numbers in the case, so that users of the report will not infer the existence of unlisted counts.

For those who have not been following the cases, GIS's pending motion for summary judgment in the King case sets out the facts underlying the case:

  • GIS reported a single criminal case that resulted in a conviction that occurred more than seven years ago.
  • As a part of reporting the conviction in the case, GIS reported that the plaintiff pled guilty to one count in the charge and that the prosecutor declined to prosecute the other counts in the charge.
  • This information was accurate, was complete, and reflected the publicly available information at the time of the report.
  • The employer decided not to hire the plaintiff on the basis of the one offense for which she pled guilty and was convicted, not on the other offenses.

The plaintiff's claim is that reporting the counts that the prosecutor charged but ultimately decided not to prosecute, as part of reporting the conviction in that same criminal case, violates the Fair Credit Reporting Act's prohibition on reporting "any other adverse item of information, other than records of convictions of crimes which antedates the report by more than seven years."

GIS filed a summary judgment motion based on the facts above, and the plaintiff's lawyers responded thoroughly. The parties disagreed over the following legal issues:

  • Whether the records that GIS reported about the criminal case are "records of conviction" that the FCRA allows.
  • Whether the information about the non-convictions was adverse to the plaintiff.
  • Whether GIS acted on a reasonable interpretation of the FCRA, so was not willfully violating it.
  • Whether the FCRA violates the First Amendment's freedom of speech by prohibiting GIS from communicating public records to someone who is not prohibited from using them.

The plaintiffs' claims in the Dowell case are similar, the main difference being that the users of the reports in the Dowell case certified that the reports were not for employment, but were for access to secure facilities.

Continuing the cases to trial would place financial and management burdens on GIS. The plaintiffs' lawyers have alleged a class action, in which the plaintiffs would represent everyone about whom GIS issued a report in which GIS reported non-conviction count information as part of a case in which a conviction occurred more than seven years ago. This class has approximately 50,000 reports in it. If the jury found GIS to have willfully violated the FCRA (erroneously, in GIS's opinion), GIS would be liable for statutory damages of $100 to $1000 per report. The risk of a runaway verdict, which would absorb resources that could be better used improving GIS's services for its clients, compels GIS to settle the case. GIS does not admit any wrongdoing in the settlement, but is agreeing to pay a total of $3.4m to settle the case.

The settlement sets important standards for the consumer-reporting industry on reporting this kind of non-conviction count information. Under the settlement, when GIS reports a criminal case in which conviction occurred and that is more than seven years old, GIS will remove all non-conviction count information. GIS has already made the operating and system changes that this settlement requires to meet this standard going forward.

The settlement acknowledges that not every report of non-conviction count information over seven years old will violate the FCRA. It therefore includes specific permission to communicate non-conviction count information in the following narrow circumstances:

  • Disclosure of non-conviction count information to the subject of that information
  • Disclosure of non-conviction count information as required by court order
  • Re-communication of archived reports to the original user where the original user is not making any current decision based on the report
  • Reports that are not governed by the FCRA (for example, a report for use in a misconduct investigation that the FCRA defines as not being a consumer report)
  • Reports where an exception in the FCRA allows reporting of non-conviction count information over seven years old
  • Reports where other law pre-empts the FCRA
  • Provision of copies of government documents including non-conviction count information when needed for audit purposes imposed by law or self-regulatory regime (for example, when an employer hires a person into a regulated position)
  • Provision of non-conviction count information for use after the subject of the report requests individualized assessment of the criminal history and the dismissed counts could be relevant to the assessment (for example, under the Equal Employment Opportunity Commission's guidance on criminal history)
  • Provision of non-conviction count information to confirm the that the subject of the report fairly reported his or her own criminal history (for example, when the subject mis-identifies the count on which conviction occurred, but does fairly identify the case)
  • Reports to be used strictly outside the United States
  • Reports to other consumer reporting agencies for their use in preparing a report to an end-user

GIS believes that these exceptions in the settlement establish clear guidance for the industry for when reporting non-conviction count information is not adverse. These exceptions allow the industry to continue playing a positive role in helping employers manage risk and promoting employment of genuinely rehabilitated offenders.

GIS and Turning Point Justice Team Up to Create Easier LP Processes- October 15th, 2013

Chapin, S.C. - GIS, a leading background screening provider, has joined forces with Turning Point Justice (TPJ) to provide Loss Prevention and Asset Protection professionals with an innovative solution that addresses the lack of criminal justice accountability for retail theft offenders.

Turning Point Justice's technology works with local criminal justice agencies and participating retailers to standardize and streamline the detention process and improve the outcome of shoplifting cases. Using equipment and technology provided free to retailers, the TPJ application uses GIS services to quickly confirm suspects' ID, verify addresses and determine the offender's eligibility to participate in a Court Alternative Program (CAP), frequently eliminating the need to involve law enforcement at that time.

The CAP and its partnership with the National Association for Shoplifting Prevention (NASP) allow qualifying offenders to voluntarily agree to pay the retailer restitution and attend a nationally recognized criminal justice rehabilitation course offered by NASP. Background Screening Survey Reveals Retail Industry Trends- April 24th, 2013

Chapin, S.C. - The Retail Industry Background Screening Benchmarking Report prepared by GIS has revealed an increased interest in ongoing criminal monitoring, a reliance on national criminal databases, and more.

The report, which is slated for release on Sunday, April 28, takes an in-depth look at retailers' background screening habits including what checks are run, what positions are screened and what checks they intend to increase their use of. One of the most prominent trends found in this report is the retail industry's desire to increase their use of ongoing criminal monitoring.

"As a background screening tool, ongoing criminal monitoring allows employers to stay current on their employees' criminal background," says Matt Robbins, Vice President at GIS and resident retail industry expert. "This rapidly expanding trend allows employers to screen their employees on an ongoing basis, rather than only pre-hire or when the employee is being considered for a promotion. In doing so, retailers can be confident that the people representing them to the world remain free of barrier records."

In addition to traditional county criminal searches, retailers indicated a heavy use of national criminal databases, with 79% of survey respondents indicating that they use a national criminal database to check at least some of their employees. As most ongoing criminal monitoring systems work off of proprietary databases, this fits well with the number of retailers currently utilizing ongoing criminal monitoring and planning to implement it.

Of special interest was the response to E-Verify. The survey was completed as the Senate proposed an immigration reform bill that would require every employer in the U.S. to utilize E-Verify within four years. The survey showed that more than a third of retailers use E-Verify in all locations as it is, while even more use it where required. There still remains a decent percentage that does not utilize E-Verify, but legislation requiring E-Verify would likely cause very little change in the retail world.

GIS Compliance Webinar Receives Pre-Approval for Re-Certification Credits from HR Certification Institute- March 26th, 2013

Chapin, S.C. - GIS' team of tax credit experts are reminding businesses that, following the recent renewal of some federal hiring programs, employers can once again earn certain valuable tax credits.

Organizations Should Overhaul Tax Credit Screening Programs Now- October 1st, 2012

While not the only group of tax credits available to corporations, Work Opportunity Tax Credits (commonly known as WOTC) are perhaps the most common. Its current inactive state gives organizations the opportunity to try out different screening partners and set up their best possible program in time for the expected full WOTC renewal.
